1. Acceptance of Terms

By downloading, installing, or using the Carissa application ("App") or accessing our website at carissatech.in ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

2. Description of Service

Carissa is an AI-powered elder care application that provides health monitoring, fall detection, daily check-ins, emergency SOS alerts, AI companionship, and related services ("Services") through smartphone sensors and connected devices. Carissa is not a medical device and does not provide medical advice, diagnosis, or treatment.

3. Eligibility

You must be at least 18 years of age to create an account. By using the App, you represent that you have the legal authority to enter into these Terms and, if setting up the App for another person (e.g., a parent), that you have their consent to do so.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate information during registration and to update it as needed. Notify us immediately at support@carissatech.in if you suspect unauthorized access.

5. Subscriptions & Payments

• Carissa offers paid subscription plans (currently ₹799/month individual, ₹1,499/month family).
• Subscriptions renew automatically unless cancelled before the end of the billing period.
• You may cancel at any time from within the App. Access continues until the current billing period ends.
• Refunds are governed by the applicable app store policies (Google Play / Apple App Store).
• We reserve the right to change pricing with 30 days' prior notice.

6. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable laws.
• Reverse engineer, decompile, or disassemble the App.
• Interfere with or disrupt the integrity or performance of the Services.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Use the App to monitor any person without their knowledge and consent.

7. Health & Safety Disclaimer

Carissa is designed to assist with elder care monitoring but is not a substitute for professional medical care or emergency services. Specifically:

• Fall detection and health alerts are AI-based estimates and may not detect all incidents.
• Always call emergency services (112) directly in a life-threatening situation.
• Health metrics (heart rate, sleep, gait) are for informational purposes only and should not be used for medical decisions.
• We do not guarantee uninterrupted service; network outages, device malfunctions, or software errors may affect alert delivery.

8. Intellectual Property

All content, features, trademarks, and technology within the App and Website are owned by Carissa and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

9. Privacy

Your use of the Services is also governed by our Privacy Policy. By using Carissa, you consent to the collection, use, and storage of your data as described therein.

10. Limitation of Liability

To the maximum extent permitted by law, Carissa and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of health, injury, or death arising from reliance on the Services. Our total liability shall not exceed the amount you paid to Carissa in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the App ceases immediately. Sections on Limitation of Liability, Intellectual Property, and Governing Law survive termination.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the App or email. Continued use after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
